WASHINGTON - The Supreme Court ruled Thursday that Americans have a right to own guns for self-defense and hunting, the justices' first major pronouncement on gun rights in U.S. history.

The court's 5-4 ruling struck down the District of Columbia's 32-year-old ban on handguns as incompatible with gun rights under the Second Amendment. The decision went further than even the Bush administration wanted, but probably leaves most firearms laws intact.

The scary part of this

The scary part of this ruling, like the recent ruling on habeas corpus, is that it only passed 5-4. And I'm not sure its a complete victory, seems to have left open a few holes for gun restrictions in the future.

Party Lines!

In the Habeous Corpus case, which is clearly in the Constitution the Liberal judges saved us.

In the Second Amendment case, which is clearly in the Constitution the Conservative judges saved us.

Kennedy seems to be the only Constitutionalist on the Court. Does anyone recall how Clarence Thomas voted in the Habeous Corpus case?

That is scary.

Only 5 of the judges were able to read the simple language of the second amendment. We came within a single vote of losing it. If the second amendment was lost the rest would be easy prey.

I'm never really clear why

I'm never really clear why people think adding more guns into society is by default, a good thing.

In our family, with its history which includes all the people we know or knew, there has never been a single insant where a gun "saved" anyone from anyone.

There have, however, been four deaths, two near deaths, and a couple of horrible injuries.

So anecdotally, having guns aound has been a negative, not a positive.

An in depth survey into the families of others would probably come up with similar findings.

Accidental shootings. Rage shootings. Mistaken identitiy shootings etc... would out number "self-defense" moments three or four to one.

I have no problem with the second Amendment granting the right to firearms, at all. I own a gun for critters and protection, I just don't understand the obsessive nature some people have over guns.

What ever happened to carrying a big stick?

A pistol for self defense; a rifle for national defense

Scott, if I were in your family I would never show up at family reunions! With that many deaths and maimings, I'm certain that your family is a statistical anomaly. Maybe a few hunter's safety courses would help clear that problem up for you.

Some people are so obsessive over guns because the government is so obsessive over relieving us of them. It's that simple.

I carry a legally concealed pistol everywhere I go for personal protection and for the protection of my family. To me, carrying a pistol is just the same as paying every month for life insurance, or wearing a seat belt--you hope you'll never have to cash in on the product, but it is there for a serious reason.

I own a rifle, though, for a little bit different reason. My rifle is for the defense of my nation--from threats both foreign and domestic. As I see it, rifles in the hands of the citizens is the tool of last resort against outright tyranny. That is what the Second Amendment is really about--protecting the nation against foreign enemies, and those at home who think they can run our lives better than we can.

People are so obsessive about their firearms because they represent FREEDOM! Never forget it!

On a slightly different subject;

On a slightly different subject; may I ask what type of handgun you carry? I'm in the process of renewing my CPL after 4 years without one. In the past I carried a Glock model 26. Now I'm looking for more of a pocket pistol. Even though the Glock is small and light, its not quite small enough for that. Also the squared off edges read through your clothes if you try to carry it in a pocket.

This ruling does not uphold the 2nd amendment. You either have a right or you don't.
